Terms of service

The tours on this website are produced by Brisbane Unexpected Pty Ltd 11 679 063 300, Milton Queensland 4064 Australia, hereafter referred to as Brisbane Unexpected. Component services such as beverages, meals, transport, sightseeing etc. are supplied by independent third parties to Brisbane Unexpected. Brisbane Unexpected does not accept liability for the actions or service standards of these third parties. All amounts listed herein are in Australian dollars (AUD) unless otherwise specified.

1) INCLUSIONS

Inclusions are listed in the FAQ section of each brochure page. Tours described are typical but not specific and may change from time to time.

2) ACCEPTANCE

Your booking becomes valid after Brisbane Unexpected has received both your payment as specified and your completed booking form and you have received a confirmation email from us. A person making a group booking is deemed to have authority from other group members to act on their behalf. We reserve the right to refuse to accept a booking based on the information revealed to us. If you are unsure about your suitability for your preferred tour please ask. By accepting our conditions this also means that you have agreed to sign up for our newsletter, please let us know if you wish for this not to happen.

3) MINIMUM NUMBERS

For all of our tours we require a minimum of two (2) people booking together and some tours may specify other minimum bookings. This is for safety and logistical reasons. Guided group tours require minimum numbers to operate and this varies from tour to tour. We may elect, at our discretion, to operate tours with small numbers. If numbers are particularly low, we may also elect to cancel or reschedule the tour.

5) BRISBANE UNEXPECTED MAY ALTER YOUR TOUR IF NECESSARY

Brisbane Unexpected reserves the right to alter tour itineraries at any time to ensure the satisfactory operation. Reasons could include but are not limited to weather, footpath quality, footpath or road closures, road conditions, change of suppliers, availability of meals, fuel, other transport etc that are necessary for the tour to operate.

6) IF BRISBANE UNEXPECTED CANCELS YOUR TOUR AND FORCE MAJEURE

a) If we have to cancel a tour, we will advise you at least 24 hours before departure.

b) If we have to cancel a tour before it has commenced, for any reason OTHER THAN FORCE MAJEURE, we will offer you the choice of either:

i) rescheduling to a different date or different tour, or

ii) accepting a full refund of monies paid (excluding any transaction fees).

Force Majeure:  If Brisbane Unexpected determines, in its sole discretion, it must CHANGE OR CANCEL before or during a Tour because of an Act of God or other political, social, environmental events like, natural or man-made disasters, bushfires, earthquakes, pandemics, floods, terrorism, civil or political upheaval, wars, strikes, riots, weather events, etc or any other or other condition beyond its control (force majeure), Brisbane Unexpected may suspend its performance, and the Brisbane Unexpected Refund/Cancellation Policy does not apply and no refunds or credits will be granted (unless as determined, at Brisbane Unexpected's sole discretion). As in the COVID event, any credits will be applied minus costs incurred and will be held by Brisbane Unexpected for 3 years so walkers can apply their credit to a walk when the force majeure event is over.

Additional Costs or Damages:  In any case, if we alter a Tour, or, cancel before or during a Tour – regardless of whether we issue any refund, Brisbane Unexpected is not responsible for any costs (such as, but not limited to any indirect, consequential, incidental or other costs/damages) incurred by you or others in your booking party, including non-refundable airline tickets or change fees.

7) IF YOU WANT TO ALTER OR CANCEL YOUR TOUR

You may reschedule or cancel your tour at no further cost, provided that you advise us in writing at least 14 days prior to the date of your booking.

If you wish to reschedule or cancel your tour less than 14 days from the date of your booking, but not less than 24 hours before the scheduled booking date/time, the following administration fees apply;

i) $25 per person to reschedule, provided your new date/tour is within 12 months from the date you advised us of the change.

ii) $50 per person to cancel

If you wish to reschedule or cancel your tour less than 24 hours before the scheduled booking date/time, no refunds, credits or compensation will be given by Brisbane Unexpected.

No refunds will be given for unused services after the tour starts. If payments are not received by the due dates we reserve the right to cancel your booking.

8) PRICE INCREASES

Whilst the website and brochure content is correct at this time or going to print, we reserve the right to change any of our published prices. If you have paid for your tour in full a price change will not apply.

Tour prices are quoted in Australian Dollars (AUD) and are based on costs where the tour is located and exchange rates at the time of booking. We do our utmost to avoid making price increases, we reserve the right to amend prices without notice as follows: (a) for any negative currency fluctuations in excess of $100, at any time until full payment is received; and (b) for any other reasons outside of our reasonable control (including without limitation, to cover changes in government taxes and charges or a force majeure event), at any time prior to providing the tour.

9) TOUR GUIDES

On guided tours, our guides are experienced mature people who take their responsibilities seriously. They are responsible for all aspects of the walking tour including group safety, enjoyment and satisfactory operation of the tour. They have the authority to do whatever is necessary to achieve these objectives. You agree to abide with the guide’s decisions.

10) YOUR RESPONSIBILITY

It is your responsibility to read the Brisbane Unexpected website thoroughly and choose a tour that fits your abilities. You must be fit enough to walk several hours in a row, including inclines and some stairs. You must understand there is a safety risk to yourself, other walkers and the guides if you cannot complete a walk in the designated time. In this case, you might be excluded from a walk/s and made to pay any costs that might be associated with being excluded, such as taxi fares, etc.

The route could include heavy rain, strong winds, high or low temperatures. It is also your responsibility to bring suitable clothing & footwear and tell us of any relevant medical conditions or special dietary requirements at the time of booking. We may not be able to supply your preferred diet. It is your responsibility to behave sensibly on the walk and not take risks. Stay on marked trails or roads. You acknowledge that you have the appropriate skills necessary to follow written directions. You are responsible for your own conduct during the tour and agree to indemnify Brisbane Unexpected against any consequent liabilities you or it may incur.

Age requirements:

Guided walks: only available to those 12 years or over. Children under 18 must be accompanied by an adult.

The parent/guardian will take full responsibility for their children and acknowledge that supervision of them will be undertaken at all times.   We reserve the right to decline a child’s participation if we do not consider the walk suitable based on difficulty level/ information provided.

11) ASSUMPTION OF RISK

You acknowledge that you have read and understand these booking conditions.

12) RELEASE AND WAIVER OF LIABILITY

a) I understand that I, and each participant in the activities, will be engaging in activities involving a real risk of serious injury or even death from various causes including but not limited to weather conditions or other causes. I voluntarily accept all risks necessarily flowing from my participation, which could result in injury or loss of life.

b) I hereby release and indemnify Brisbane Unexpected (including its directors, employees, principals, agents and independent contractors) and all persons or corporations associated directly or indirectly with the conduct of the activities from all claims, demands and proceedings arising out of my participation in the activities and hereby indemnify them against all liability (including liability for their negligence and the negligence of others) for all injury, loss or damage arising out of or connected with my participation in the activities. This release shall extend to and include Brisbane Unexpected and the organiser, partners, managers, officers, agents, contractors, organisation and volunteers including medical and paramedical personnel appointed for the activities, the owners, licensees, and occupiers of land on which the activities or any part of it are conducted or which is involved directly or indirectly with the activities in any manner whatsoever and activities organisers. This release and indemnity continues forever and binds my heirs, executors, personal representative and assigns.

e) I have independently assessed the activities and confirm and warrant I am physically fit to participate in the activities in which I have chosen to participate, and I have not been advised otherwise by a medical practitioner. I do not have any possible relevant pre-existing medical or physical conditions, which may compromise my ability to undertake the activity. No physical ailments have been disclosed to Brisbane Unexpected.

f) I consent to receiving any medical, e.g. first aid, treatment that Brisbane Unexpected considers reasonably necessary during or after the activities.

g) I hereby acknowledge that I have the sole responsibility for my personal property during the activities.

h) I acknowledge the terms and conditions of this document are contractual in nature, are intended to have legal effect and are not a mere warning or recital. Brisbane Unexpected is not responsible for my decision to participate in the activities and I was not induced by Brisbane Unexpected to do so. I acknowledge my registration is not transferable to any other person. I have read this document, understand its contents and completely agree with it of my own free will.

13) PAYMENTS

All prices are in Australian dollars, unless otherwise specified, and payment may only be made in Australian dollars.

14) INSURANCE

We require that you have adequate travel insurance against potential losses, damage or injury.

16) COMPLAINTS

We want to provide you with an enjoyable walking tour, but no matter how careful we are, things might sometimes go wrong. We’d like to have complaints remedied as quickly as possible. If you have a difficulty or complaint during your tour please immediately bring it to the notice of your guide. He/she will be interested in your welfare and should be able to provide a remedy so you can continue to enjoy your tour. If the problem cannot be resolved, contact Brisbane Unexpected immediately by phone or email.

17) CONTACT WITH US

By completing your booking form you agree with the booking conditions and you have agreed to have contact from us. There is no other way for us to effectively deliver what we do. If you do not wish to have this contact please let us know right now at admin@brisbaneunexpected.com.au alternatively, you will always have the option to unsubscribe at a later date.

18) JURISDICTION

This agreement and the rights and responsibilities of the parties will be construed and take effect in accordance with and be governed exclusively  by the laws of Queensland.
